These Terms of Use (“Terms”) govern your access to and use of our website, https://wp.paydirtdata.com (the “Site”), and any related services, data feeds, APIs, analytics tools, models, or content (collectively, the “Services”). By accessing or using the Site or Services, you agree to be bound by these Terms. If you do not agree, you may not access or use the Services.

By registering for an account, using the Site, or accessing any of the Services, you agree to comply with and be bound by these Terms and our Privacy Policy, incorporated herein by reference. You represent and warrant that you are at least 18 years old (or the legal age of majority in your jurisdiction) and have full power and authority to enter into these Terms.

2. Changes to Terms

We may modify these Terms at any time. When we do, we will revise the “Last updated” date above and post the updated Terms on the Site. Continued use after changes constitutes acceptance of the new Terms.

3. Description of Services

  • Daily Fantasy Sports (DFS) Data & Analytics: Player statistics, projections, ownership forecasts, lineup optimizers, etc.
  • Sports Betting Models: Simulation-based odds, expected value calculations, bankroll management tools, and model outputs.
  • APIs & Data Feeds: Programmatic access (where offered) subject to rate limits and licensing.

All Services are intended for personal, non-commercial use unless you have a separate commercial agreement with us.

4. User Accounts

Registration: To access certain features, you must create an account and provide accurate, complete information.

Account Security: You are responsible for safeguarding your password and account and for all activity under your account. Notify us immediately of any unauthorized use.

5. User Conduct & Prohibitions

Lawful Use: You agree to use the Services only for lawful purposes and in accordance with these Terms.

Prohibited Activities: You may not, without limitation:

  • Copy, reproduce, distribute, or create derivative works of our content except as expressly permitted.
  • Circumvent any usage limits or technical restrictions.
  • Use bots, scrapers, or automated means to access or collect data.

9. Limitation of Liability

To the fullest extent permitted by law, Paydirt Analytics, LLC and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of the Services. Our total aggregate liability for any claim will not exceed the amount you paid us in the 12 months preceding the claim (or $100 if you have paid us nothing).

10. Indemnification

You agree to indemnify and hold harmless Paydirt Analytics, LLC and its affiliates from any claims arising from your violation of these Terms or misuse of the Services.

11. Termination

We may suspend or terminate your access to the Site or Services, with or without notice, for any violation of these Terms or any law. Upon termination, all rights granted to you under these Terms will cease.

12. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Illinois. Any dispute will be resolved exclusively in courts located in Chicago, Illinois. You consent to personal jurisdiction there.

13. Miscellaneous

  • Severability: If any provision is held invalid, the remainder will continue in full force.
  • Waiver: Our failure to enforce any provision does not constitute a waiver.
  • Assignment: You may not assign these Terms without our consent; we may assign at any time.
